  • 1 conclusion of contract

(1) A safekeeping contract is concluded between the owner of the dog or the dog owner who takes care of the dog (future dog owner) and the dog hotel Dog Resort Moonbow (future "Moonbow Dogs"). For the duration of the contract, "Moonbow Dogs" guarantees each dog placed in custody appropriate care and support, sufficient food, water and exercise in the fenced private area. "Moonbow Dogs" undertakes to look after the dog individually and in a manner appropriate to the species and to do everything possible for the dog's well-being in order to facilitate the separation from the dog owner.

(2) The safekeeping contract is concluded by accepting (signing) the application (Sweety-Check-in) from the dog owner or a person commissioned by him and "Moonbow Dogs" and by sending the online Sweety-Check-in completed by the dog owner.

(3) The conclusion of the contract obliges the parties to the contract to fulfill it, regardless of how long the contract has been concluded.

(4) The subject of the contract is the custody, supply and care of the animal.

 

  • 2 dog sitting

(1) The dog owner could visit the Dog Resort Moonbow in advance. He expressly agrees to the state of the facility. At check-in, the dog owner was informed in detail about the accommodation and husbandry at "Moonbow Dogs".

(2) The dog will be accommodated in the booked dog room, unless it has to be relocated due to space or other reasons. The decision on the composition of the dogs within the scope of the runs is at the due discretion of "Moonbow Dogs", taking into account the bookings/requests of the dog owner. Ultimately, the decision on the compatibility of the dog handed over to the Dog Resort Moonbow rests with "Moonbow Dogs".

If the dog has an intolerance to other dogs that has not been specified in advance and has to be taken out into the exercise area individually during the care period, an additional daily fee will be charged.

 

  • 3 Information provided by the dog owner

(1) "Moonbow Dogs" is under no obligation to verify the ownership or ownership of the dog. "Moonbow Dogs" may rely on the written information provided by the dog owner or their representative when the contract was concluded (Sweety Check-in) and on the entries in the vaccination certificate. The dog owner declares primarily and legally binding that he is the owner and keeper of the dog.

(2) The dog owner assures that all information is complete and true.

(3) Liability insurance is mandatory for dogs in some regions of the world. Please enter the insurance company and insurance number in the Sweety check-in form, if available.

(4) If there is no liability insurance, the dog owner is fully and immediately liable for any damage when picking up the dog.

(5) The dog owner is obliged to inform "Moonbow Dogs" of any physical or psychological problems and suspected illnesses in the dog before the dog is handed in.

 

  • 4 behavioral problems

(1) "Moonbow Dogs" is entitled, at its own discretion, to separate dogs that show behavior during the stay that bothers or even endangers themselves, other dogs or people.

(2) In order to protect our guest dogs and us, a dog that behaves in a destructive and/or aggressive manner must be picked up immediately by the dog owner or a person authorized by him. If it is not possible to pick up the dog, the dog owner must bear the costs for keeping the dog alone in the room, in the dog house and on the playground.

(3) It is clear to the dog owner that he gives his dog to the Dog Resort Moonbow at his own risk. Also expressly related to the other dogs or to arguments between the dogs and their possible consequences of injury.

(4) "Moonbow Dogs" will inform the dog owner immediately if his dog has health or psychological problems or if the dog has adjustment difficulties that exceed the usual level.

 

  • 5 health

(1) Peculiarities and exceptions in terms of food and medical care must be specified by the dog owner on the Sweety check-in form before the dog is admitted. "Moonbow Dogs" is not liable for any consequences of missing or incorrect information.

(2) In the event of an injury and/or illness of the dog during the stay, "Moonbow Dogs" will inform the dog owner immediately. If, in Moonbow Dogs' opinion, the dog's injury/illness requires veterinary treatment, the dog will be presented to a veterinarian and accordingly treated according to the veterinarian's expertise. The dog owner assumes the resulting costs in full. There is no upper limit for possible veterinary treatment costs. The veterinarian or other competent third party and the treatment are at the discretion of "Moonbow Dogs". In this case, "Moonbow Dogs" is specifically authorized to commission a veterinary practice with the veterinary treatment and care of the dog on behalf of and for the account of the dog owner. In addition, the dog owner authorizes "Moonbow Dogs" to commission other and/or further treating veterinarians and clinics with the care of the dog in his name and on his account, if this should appear necessary according to the findings of the veterinary practice. If "Moonbow Dogs" has paid in advance for treatment measures, the dog owner shall indemnify "Moonbow Dogs" for all costs incurred, even if he personally declines the treatment or service or would not have had it carried out himself.

If the dog has to be housed separately due to illness and taken to the playground, an additional daily flat rate will be charged for the additional work.

(3) The dog owner shows or hands over a copy of the dog's vaccination card and assures that the dog has received the following vaccinations within the past year: rabies, distemper, hepatitis, leptospirosis, parvovirus. If this is not the case, "Moonbow Dogs" is entitled to withdraw from the care contract. At the request of "Moonbow Dogs" the dog owner must provide proof of current vaccination protection. If no sufficient vaccination protection can be proven, the admission of "Moonbow Dogs" can be refused, the agreed price for the stay is still due if the reserved place cannot be occupied by another dog.

(4) The dog must not have any contagious diseases or parasites such as e.g. B. mites, fleas, lice or the like. We recommend treatment with an insect repellent (fleas, lice, mites) and arachnids (ticks) 48 hours before dropping off at Dog Resort Moonbow. In the Sweety check-in, every dog ​​is tested for fleas and ticks and conspicuous, visible diseases. If a dog can be shown to have brought an infectious disease with him, the dog owner is responsible for this and bears the resulting costs for disinfection, preventive care and joint treatment of infected dogs.

(5) If the dog owner suspects that the dog is ill, this must be expressly pointed out. "Moonbow Dogs" accepts no liability for sick dogs and consequences of the disease.

(6) If a bitch could come into heat, "Moonbow Dogs" must be expressly informed in advance. If the dog owner has placed a bitch in heat for supervision and "Moonbow Dogs" does not tell, the possible consequences (covering of the bitch during the retirement period) assumes no liability whatsoever. The costs are entirely and solely at the expense of the dog owner.

(7) If a veterinarian requests "Moonbow Dogs" to consent to the euthanasia of the dog due to a corresponding need, "Moonbow Dogs" is entitled to grant the necessary permission if the decision of the dog owner is not made immediately or within a reasonable time , without the dog having to suffer, can be caught.

 

  • 6 picking up the dog

(1) No later than on the last day of the agreed care period, the dog given in care will be picked up by the dog owner during the opening times of "Moonbow Dogs" or at the agreed time. If the dog is not picked up at the agreed pick-up time by the dog owner or a person authorized by him in writing and "Moonbow Dogs" cannot reach the owner or the representative either by telephone or in writing and has tried several times and the Dog Resort Moonbow will not or has not been informed of a delay informed, "Moonbow Dogs" is forced to hand over the dog to an animal welfare association/animal shelter after a reasonable period of at least two weeks and at most four weeks.

 

  • 7 Liability

(1) Personal injury or damage to property caused by the dog during the care are at the expense of the dog owner. Moonbow Dogs assumes no liability. The dog owner bears any damage to third parties or foreign animals.

(2) "Moonbow Dogs" is not liable for injuries and/or illnesses of the dog to be cared for, regardless of whether these are caused by the dog itself or by other animals.

(3) It is up to the dog owner to claim liability insurance. However, "Moonbow Dogs" is not obliged to be referred to the insurance company for the assertion of claims, but can demand the full extent of the damage from the owner.

(4) If the dog poses a risk during the stay (e.g. a dog bites the staff), a further stay at "Moonbow Dogs" is not justifiable due to the danger to the staff. After the information, the dog owner is obliged to pick up his dog as soon as possible. If he does not pick up his dog, "Moonbow Dogs" is entitled to accommodate the dog in a single room and to restrict the contractual services so that there is no risk to the staff.

(5) "Moonbow Dogs" assumes no liability for the death of a dog.

(6) No liability can be assumed for personal items brought along, such as blankets, baskets, leashes, collars. Documents, medicines etc. forgotten at the Dog Resort Moonbow must be picked up by yourself.

 

  • 8 Payment, Due Date

(1) The care costs are to be paid in advance and in full in cash when the dog is handed over to the Dog Resort Moonbow. A verifiable transfer made in advance is also sufficient. If the dog is picked up early, there is no mandatory partial reimbursement of the care costs.

(2) Additional services rendered during the care period, e.g. B. Payment for an extended stay, additional expenses, additional services booked at a later date or veterinary visits must be paid in cash when the dog is picked up. "Moonbow Dogs" has a right of retention/lien on the dog until full payment has been made.

(3) The current prices stated on the "Moonbow Dogs" website always apply: www.moonbow-dogs.de

(4) If the dog owner withdraws from the contract before the agreed delivery date, compensation is to be paid as follows:

- 0% per dog up to and including 21 days before the delivery date

- between 20 and 10 days inclusive before the delivery date, 20% per dog

- between 9 and 4 days before the deadline, 50% per dog

- from 3 days before 80% per dog of the agreed amount.

If the dog owner does not cancel and does not appear on the delivery date, 100% of the agreed amount per dog is due. If there is no communication with "Moonbow Dogs", we will charge EUR 3.00 for each reminder in the event of late payment. After the 2nd unsuccessful reminder, we feel compelled to commission a collection agency.

 

  • 9 Withdrawal from Contract and Extraordinary Termination

(1) If a withdrawal from the contract has been agreed in writing between the dog owner and Moonbow Dogs within a certain period of time, "Moonbow Dogs" is also entitled to withdraw from the contract during this period if there are customer inquiries about the booked times and the dog owner responds to a request from " Moonbow Dogs" has not waived its right of withdrawal.

(2) If the dog owner does not pay a previously agreed advance payment even after a reasonable grace period set by "Moonbow Dogs" has expired with an announcement of a rejection, "Moonbow Dogs" is entitled to withdraw from the contract.

(3) The dog owner is obliged to inform "Moonbow Dogs" of his dog's bad habits (fearful, aggressive, biting, etc.) or existing illnesses (herniated disc, injuries, etc.) or intolerances (male dogs, eating ...) without restriction . The dog owner must also expressly point out the requirements of the dog (muscle or leash requirement). If the dog owner has not done this, "Moonbow Dogs" can terminate the care contract extraordinarily and without notice.

(4) "Moonbow Dogs" is entitled to extraordinarily withdraw from the contract for an objectively justifiable reason, for example if:

-> "force majeure" (storm/water/fire damage, lightning strike, earthquake, war, legally ordered closure due to e.g. Corona etc.) or other circumstances for which "Moonbow Dogs" is not responsible that make it impossible to fulfill the contract make

-> Dog rooms are booked with deceptive or incorrect information about important facts

-> "Moonbow Dogs" reasonably believes that the safety of the team and/or the other dogs is at risk

(5) "Moonbow Dogs" must inform the dog owner immediately of the effective date of the withdrawal from the contract. In the event of a justified withdrawal from "Moonbow Dogs", the dog owner has no right to compensation.

 

  • 10 Storage of Data

(1) The dog owner gives "Moonbow Dogs" his express consent to the collection and processing of his personal data.

(2) The dog owner agrees to the transfer of personal data and that of the dog for necessary veterinary treatment.

 

  • 11 video and photo recordings

(1) The dog owner agrees that photos and videos of his dog may be taken, used and published during the stay.

(2) The entire area and the premises of "Moonbow Dogs" are video-monitored and alarmed. These video recordings are only available to "Moonbow Dogs" and are not intended for private purposes.

(3) The recordings of the booked live view of the booked dog room may not be published under any circumstances. They serve the sole purpose of allowing the dog owner to see his own dog in the booked room during the stay at "Moonbow-Dogs".

(4) The dog owner waives the right to claim any compensation.

 

  • 12 Miscellaneous

(1) Agreed deadlines and orders (verbal, in writing or after the contract has been signed) are binding.

(2) By signing the Sweety check-in form and confirming and completing the Sweety online check-in booking order, the dog owner confirms that they have read and understood the contractual conditions on the "Moonbow Dogs" website and to have accepted. If changes are made to the contract, we will announce them in advance and they will take effect immediately. Old contracts lose their validity.

(3) The signed Sweety check-in form must be available at the latest when care begins. Should this not be the case, "Moonbow Dogs" reserves the right to terminate the contract prematurely or not to start until the signed contract has been received.

(4) All offers are non-binding. Errors, mistakes and changes are reserved.

(5) Place of jurisdiction is Paphos.

(6) Severability clause: The invalidity of individual provisions does not affect the validity of the remaining parts of the contract.

(7) Written form requirement: Additional agreements have not been made. These are to be included in the contract separately and in writing.
